1. About These Terms

These Terms & Conditions ("Terms") govern your use of the New Zealand Dance Arts Association ("NZDAA", "we", "us", "our") website at www.nzdaa.nz and all services offered through it, including memberships, assessments, teacher development programmes, events, and related activities.

By accessing our website, creating an account, registering for any examination or programme, or making a payment, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Who We Are

NZDAA is a professional dance association based in Aotearoa New Zealand. We support dance professionals, studios, and dancers through the development of standards, assessments, and structured pathways.

3. Eligibility

You may use our services if:
- You are 18 years of age or older, or
- You are under 18 and your parent or legal guardian has consented to your participation and accepts these Terms on your behalf.

Studios and organisations registering on behalf of their students confirm they have obtained appropriate consent from each student and, where applicable, their parents or guardians.

4. Account Registration

To register for assessments or programmes, you must create a member account. You agree to:
- Provide accurate, current, and complete information
- Keep your account credentials confidential
- Notify us promptly of any unauthorised use of your account
- Be responsible for all activity that occurs under your account

NZDAA reserves the right to suspend or terminate accounts that contain false information, are used inappropriately, or breach these Terms.

5. Examinations, Programmes, and Services

5.1 Available Services
NZDAA currently offers:
- Artistic Examination Syllabus (Levels 1–10)
- Fundamentals Examination Syllabus (Levels 1–10)
- Artistic Teacher Training programmes
- Fundamentals Teacher Training programmes

5.2 Registration
Registration for any examination or programme is only confirmed once full payment has been received and you have received written confirmation from NZDAA.

5.3 Session Schedule
NZDAA conducts official assessment sessions twice per year (July and December). Exact dates, times, and venues will be communicated by email after registration. NZDAA reserves the right to adjust scheduling based on examiner availability, candidate numbers, and operational requirements.

5.4 Assessment Outcomes
All assessment outcomes are determined by NZDAA-appointed examiners and are final. Feedback reports and certificates are issued at NZDAA's discretion in accordance with our published standards.

6. Fees and Payment

6.1 Fees
All fees are listed in New Zealand Dollars (NZD) on the relevant programme page and are inclusive of any applicable taxes unless stated otherwise.

6.2 Accepted Payment Methods
- Credit or debit card (processed securely via Stripe)
- Bank transfer (manual payment to NZDAA's nominated account)

6.3 Payment Timing
Card payments are processed immediately. Bank transfers must be received within 5 business days of registration. Registrations with outstanding payment beyond this period may be cancelled at NZDAA's discretion.

6.4 Currency and Charges
Bank fees, currency conversion charges, or third-party transaction fees incurred by you are your responsibility.

7. Cancellations and Refunds

Cancellations and refunds are governed by NZDAA's Refund & Cancellation Policy, which forms part of these Terms.

8. Intellectual Property

All content on www.nzdaa.nz — including text, logos, syllabi, assessment materials, images, and documents — is the intellectual property of NZDAA or its licensors and is protected by New Zealand and international copyright law.

You may not:
- Reproduce, distribute, or republish our materials without prior written permission
- Use NZDAA branding, name, or syllabus content to imply endorsement or affiliation without authorisation
- Adapt or translate our materials for commercial use

Limited personal use of materials provided to you as part of your registration (such as feedback reports and certificates) is permitted.

9. Conduct and Code of Practice

By participating in any NZDAA programme, examination, or event, you agree to:
- Conduct yourself respectfully towards examiners, staff, fellow participants, and venue personnel
- Follow safety instructions and venue rules
- Not engage in behaviour that disrupts the assessment process or the experience of others
- Disclose any medical conditions or injuries that may affect your participation

NZDAA reserves the right to remove or disqualify participants who breach this Code, without refund.

 

10. Health, Safety, and Liability

Dance involves physical activity that carries inherent risks of injury. By registering, you confirm that:
- You (or your child) are physically fit to participate
- You have disclosed any relevant medical conditions or injuries
- You participate at your own risk

To the maximum extent permitted by New Zealand law, NZDAA is not liable for any injury, loss, or damage arising from your participation, except where caused by our gross negligence or wilful misconduct.

Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 or other non-excludable consumer protection legislation in New Zealand.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

12. Third-Party Services

Our website integrates with third-party services including Wix (hosting), Stripe (payments), and email service providers. Your use of these services may be subject to their own terms and policies. NZDAA is not responsible for the practices of third parties.

13. Changes to These Terms

NZDAA may update these Terms from time to time. The current version will always be available on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.

For significant changes that affect existing registrations, we will notify affected users by email.

14. Termination

NZDAA may suspend or terminate your access to our services if you breach these Terms. You may close your account at any time by contacting info@nzdaa.nz.

15. Governing Law and Disputes

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of our services will be resolved in the courts of New Zealand.

Before pursuing legal action, we encourage you to contact us first at info@nzdaa.nz so we can attempt to resolve any concerns directly.
